These Terms of Use (“Terms”) govern your access to and use of Crosswise, including readcrosswise.com, Crosswise newsletters, free memberships, paid memberships and other services made available by Crosswise.

Crosswise is operated by [LEGAL ENTITY], of [REGISTERED ADDRESS] (“Crosswise”, “we”, “us” or “our”).

By accessing or using Crosswise, you agree to these Terms. If you purchase a paid subscription, these Terms also form part of the agreement governing that subscription.

Nothing in these Terms limits any mandatory consumer right that cannot lawfully be excluded or restricted.

1. About Crosswise

Crosswise is an independent editorial publication providing journalism, research, analysis, commentary and related material on matters of public interest.

Crosswise aims to distinguish established facts from interpretation, disclose material uncertainty and provide readers with evidence supporting important claims. Nevertheless, journalism necessarily involves judgement, incomplete information and information that may subsequently change.

Publication by Crosswise does not constitute a guarantee that every fact, source, interpretation or conclusion will remain unchanged indefinitely.

Where appropriate, Crosswise may correct, clarify, update or amend previously published material.

2. Access to Crosswise

Some Crosswise material may be available without registration. Other material may require a free membership or paid subscription.

We may change which material is freely available and which material is restricted to members or paying subscribers.

Creating an account does not give you ownership of that account or any Crosswise content. It provides you with a personal, limited right to use the relevant Crosswise service in accordance with these Terms.

You are responsible for maintaining the security of any account or access credentials associated with your membership.

You must not knowingly permit another person to use your personal paid membership as a substitute for obtaining their own subscription.

3. Paid Subscriptions

Crosswise may offer monthly, annual or other paid subscription plans.

The applicable subscription price, billing frequency, included benefits and any introductory offer will be displayed before you complete your purchase.

Unless expressly stated otherwise, subscriptions are personal and non-transferable.

Automatic renewal

Where a subscription is described as recurring, it will renew automatically at the applicable billing interval until cancelled.

By purchasing a recurring subscription, you authorise our payment provider to charge the applicable subscription fee and any legally required taxes at each renewal.

Cancelling a subscription

You may cancel a recurring subscription through the membership or account controls made available by Crosswise or by contacting us.

Unless applicable law requires otherwise, cancellation prevents the next renewal and your paid access will normally continue until the end of the period for which you have already paid.

Cancelling a subscription is different from exercising a statutory right of withdrawal where such a right applies.

Price changes

Crosswise may change subscription prices from time to time.

A new price will not ordinarily be applied retrospectively to a subscription period for which you have already paid. Where a price change affects a future renewal, we will provide any advance notice required by applicable law.

If you do not wish to continue at the new price, you may cancel before the relevant renewal.

4. Payments

Payments for paid Crosswise memberships are processed through Stripe or another payment processor identified during checkout.

Payment processors may collect and process your payment information under their own terms and privacy policies.

Crosswise does not ordinarily receive or store your complete payment-card details.

You are responsible for providing valid payment information and for keeping relevant billing information current.

5. Refunds and Statutory Withdrawal Rights

Except where required by law or expressly stated as part of a particular offer, subscription payments are not automatically refundable merely because you stop using Crosswise before the end of a billing period.

This does not affect statutory consumer rights.

If you are a consumer in the European Union or another jurisdiction providing a statutory cooling-off or withdrawal period for distance contracts, you may have the right to withdraw from an eligible contract within the legally prescribed period, including, in many circumstances, a period of 14 days.

Where you expressly request that provision of a service begin during a statutory withdrawal period, the consequences of doing so will be determined by applicable consumer law. Depending on the nature of the subscription or digital content supplied, you may be required to pay a proportionate amount for services already provided, or a statutory exception to the withdrawal right may apply where all legally required consents and acknowledgements have been obtained.

Crosswise will not interpret these Terms as removing a withdrawal, cancellation, refund, conformity or other consumer right that applicable law requires us to provide.

6. Intellectual Property

Unless otherwise indicated, Crosswise owns or is licensed to use the copyright, trademarks, design, text, graphics, data presentations and other material published by Crosswise.

Your subscription gives you access to Crosswise content. It does not transfer intellectual-property ownership to you.

You may:

  • read Crosswise content for personal use;
  • quote reasonable excerpts where permitted by copyright law and accompanied by appropriate attribution;
  • share links to Crosswise articles; and
  • use material in any other manner expressly permitted by applicable copyright law.

Without prior written permission, you may not:

  • reproduce or republish substantial Crosswise articles in full;
  • systematically copy or archive Crosswise content;
  • redistribute paid or subscriber-only content in a manner designed to substitute for a subscription;
  • sell, sublicense or commercially exploit Crosswise content;
  • remove copyright or attribution notices;
  • scrape or systematically extract substantial parts of the Crosswise website or archive; or
  • create or maintain a competing database, publication or content service substantially derived from Crosswise material.

Nothing in these Terms limits lawful quotation, criticism, review, research, reporting, parody or other uses protected by applicable copyright law.

7. Automated Access, Data Mining and Machine Use

Except where required or permitted by law, you may not use automated systems to obtain substantial quantities of Crosswise content in a manner that circumvents technical controls, subscription restrictions or normal website access.

You may not use Crosswise paid or restricted content as a bulk source for training, developing or populating a commercial machine-learning model, generative system, content database or competing information product without our prior written permission, except to the extent that such restriction is prohibited by applicable law.

Search engines and other services may index publicly accessible Crosswise pages to the extent permitted by our technical settings and applicable law.

8. Editorial Material Is Not Professional Advice

Crosswise publishes journalism, research, analysis and commentary for informational and editorial purposes.

Nothing published by Crosswise constitutes personalised:

  • investment or financial advice;
  • legal advice;
  • tax advice;
  • medical advice;
  • security advice; or
  • any other regulated professional service.

Crosswise may report on companies, markets, litigation, regulation, public policy, security issues and other matters that could influence personal or commercial decisions. Readers remain responsible for evaluating such information and obtaining appropriate professional advice where necessary.

No Crosswise article should be treated as an instruction to buy, sell, invest, litigate or take any other particular action.

9. Accuracy, Sources and Developing Information

Crosswise seeks to publish accurate, evidence-led material. However, we do not warrant that every piece of information published will be complete, error-free or current at every moment.

Among other things:

  • official information can later be revised;
  • witnesses and sources may disagree;
  • public records can be incomplete;
  • data may contain errors;
  • investigations may remain unresolved;
  • legal proceedings can materially alter established facts; and
  • reasonable analysts may reach different conclusions from the same evidence.

Crosswise distinguishes analysis from fact where practicable, but editorial conclusions remain interpretations based on the evidence available at the time of publication.

We may correct or update material without preserving every previous version on the public website.

Crosswise frequently links to primary documents, official records, academic material, media reporting, databases and other external sources.

A link does not imply that Crosswise controls, endorses or accepts responsibility for the third-party website or everything published by that organisation.

Third-party services are governed by their own terms and policies.

Crosswise is not responsible for the continued availability of external links or material that a third party subsequently changes, moves or removes.

11. Reader Communications and Submissions

Readers may contact Crosswise with corrections, information, suggestions, questions or other correspondence.

Unless Crosswise expressly agrees otherwise, sending ordinary correspondence does not create a confidential, fiduciary, professional or source relationship.

If Crosswise provides a designated process for confidential journalistic communications or source material, readers should use that process rather than ordinary website forms or standard email.

We do not claim ownership of facts, ideas or information submitted by readers merely because they have been sent to us.

However, where you voluntarily submit material specifically for possible publication — such as a comment, testimonial or letter intended for publication — you grant Crosswise permission to reproduce, edit and publish that material for the purpose for which it was submitted, subject to applicable law.

12. Acceptable Use

You must not use Crosswise to:

  • violate applicable law;
  • attempt to gain unauthorised access to our systems;
  • introduce malicious software or code;
  • interfere with the operation or security of the website;
  • circumvent subscription or access controls;
  • impersonate another person;
  • engage in fraudulent activity;
  • systematically harvest personal information concerning other users; or
  • use any interactive feature to threaten, harass or unlawfully abuse another person.

We may restrict or suspend access where reasonably necessary to protect Crosswise, other users, our systems or our legal rights.

13. Availability and Changes to the Service

We aim to keep Crosswise available and reliable, but uninterrupted access cannot be guaranteed.

The website may occasionally be unavailable because of maintenance, technical problems, security incidents, third-party infrastructure failures or circumstances outside our reasonable control.

We may add, remove or modify features and editorial products over time.

For paid subscribers, we will not intentionally make a material change to the core nature of a paid subscription without taking account of applicable contractual and consumer-protection obligations.

14. Disclaimer of Warranties

To the maximum extent permitted by law, Crosswise is provided on an “as available” basis.

We do not make warranties beyond those that cannot lawfully be excluded, including any guarantee that:

  • the website will always be uninterrupted;
  • every external source will remain available;
  • every article will remain unchanged;
  • all information will be error-free; or
  • use of Crosswise will produce any particular result.

Nothing in this section excludes statutory guarantees or conformity rights that apply to consumers under mandatory law.

15. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be limited under applicable consumer law.

Subject to that principle, Crosswise and its operator will not be liable for indirect, incidental or consequential loss arising solely from reliance upon editorial information, disruption of the website or the acts of third-party websites or services, to the extent such liability may lawfully be excluded.

Readers remain responsible for decisions made on the basis of information they read.

These Terms do not exclude liability for fraud, fraudulent misrepresentation, intentional misconduct, death or personal injury caused by negligence where such liability cannot lawfully be excluded, or any other liability that applicable law makes non-excludable.

16. Suspension or Termination

We may suspend or terminate an account where we reasonably believe that:

  • these Terms have been materially breached;
  • subscription access is being systematically shared or redistributed;
  • the account is being used fraudulently;
  • payment has failed and remains outstanding;
  • the account presents a security risk; or
  • suspension is otherwise required by law.

Where reasonable and legally required, we will provide notice and an opportunity to remedy the issue.

Termination by Crosswise does not remove any refund or other remedy that mandatory consumer law requires.

17. Privacy

Our collection and use of personal information are governed by the Crosswise Privacy Policy, which forms a separate part of the legal information available on the website.

18. Changes to These Terms

We may update these Terms where reasonably necessary to reflect changes in the service, business, technology or law.

The current version will be published on this page together with the date it was last updated.

If we make a material change that adversely affects an existing paid subscription, we will provide notice where required by law and will respect any cancellation or other rights that applicable law provides.

19. Governing Law

These Terms are governed by the laws of [GOVERNING JURISDICTION], subject to any mandatory consumer-protection rules that apply in the country in which you are habitually resident.

If you are a consumer, nothing in this clause deprives you of protections that cannot lawfully be excluded under the law applicable to you.

Specific subscription terms presented at checkout take precedence over these general Terms where they expressly state that they do so.
